Curriculum Lessons

Orientation to Online Learning (online)  

This lesson introduces you to online learning, with instruction on how to be successful as an Ashworth student. You'll learn proven study skills, find out how to take advantage of different learning styles, and discover time management techniques. The lesson also includes a guide to career opportunities plus supplementary readings.

Lesson 1: Introduction to Civil Procedure  

Introduces the American judicial system and the important distinctions between civil law and other types of law, as well as sources of judicial authority. You will also learn about the major features of the federal and state court systems and the role of judges, lawyers, clients, and paralegals.

Lesson 2: The Law Firm, Pleadings and Jurisdiction  

Examines the personnel and internal organization of a law firm. You will learn how to evaluate a civil case and the many requirements that must be satisfied before a civil lawsuit can be brought against a defendant. You also will be introduced to jurisdictional questions, standing and other legal elements of complaints.

Lesson 3: The Defendant's Answer, and Evidence  

Covers all the aspects of the defendant's answer, including admissions, denials, the consequences for failing to deny the plaintiff's allegations, counterclaims, cross-claims, other elements of third-party practices and class-action suits. You will also learn about the importance of evidence, both direct and circumstantial, and the rules of evidence.

Lesson 4: Discovery and Motions Practice  

The discovery phase of litigation in civil cases. You will also learn about the critical nature of motions practice and several different types of motions, including those directed at specific evidence and those that seek to dismiss the entire case.

Lesson 5: Trial of a Civil Action and Damages  

Examines the various phases of a trial as well as the paralegal's role in helping prepare for and participate in a civil case. You will also learn about the different forms of damages available in civil cases.

Lesson 6: Alternatives to Litigation, and Appeals  

Examines the issues surrounding mediation and arbitration, the effect they have on modern litigation practices, and when and how a party may appeal an adverse ruling. You will also learn about the issues that arise on appeal, how appellate courts are organized, and what actions appellate courts are authorized to take.

Program Description

A Civil Litigation Career Certificate provides students with the specialized knowledge for real-world application in the legal profession. Students will gain a solid understanding of civil procedure, pleadings, evidence, motions, damages, appeals, and other civil litigation.

Program Objectives

After completing the Civil Litigation certificate program, students will be able to:

  1. Differentiate civil law from other types of law and sources of judicial authority.
  2. Outline the structure of the federal and state court systems and describe the similarities and differences between the two.
  3. Describe the rules and procedures that must be followed when filing and conducting a civil lawsuit in the federal court system, and explain where state-specific and court-specific procedures and rules may be found.
  4. Explain the roles and responsibilities of the paralegal, as well as the ethical standards to be demonstrated, while assisting an attorney through all phases of civil litigation.
  5. Identify career opportunities for students with the appropriate training in this specialty area.
